1. Agreement to Terms
By accessing or using the website at pugodesigns.com or by engaging Pugo Design Studio for any service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.
These terms apply to all visitors, clients, and anyone who accesses or uses our website or engages with our services.
2. About Pugo Design Studio
Pugo Design Studio is a full-service branding and creative design studio based in Cebu, Philippines. We provide branding design, print design, marketing design, web design and development, and motion graphics services to clients primarily in the US, Australia, Singapore, New Zealand, Canada, and the United Arab Emirates.

3. Services
3.1 Scope of Work
All services provided by Pugo Design Studio are governed by a separate project agreement, proposal, or scope of work document sent to the client prior to the start of any project. These Terms of Service apply alongside that agreement. In the event of a conflict, the signed project agreement takes precedence.
3.2 Fixed-Rate Projects
Fixed-rate projects are scoped and priced before work begins. The agreed scope, deliverables, revision rounds, and timeline are set out in the project proposal. Work outside the agreed scope is subject to additional fees, which will be communicated and approved before proceeding.
3.3 Retainer and Ongoing Support
Retainer engagements operate on a monthly cycle. Unused hours or credits do not roll over to the following month unless otherwise agreed in writing. Retainer agreements may be cancelled with 30 days written notice.
3.4 Revisions
The number of revision rounds included in each project is stated in the project proposal. Requests beyond the included revision rounds are billed at our standard hourly rate or quoted separately.
4. Payment Terms
4.1 Deposits and Milestones
All projects require a deposit before work begins. The deposit amount and payment milestones are stated in the project proposal. Work does not commence until the deposit is received and cleared.
4.2 Payment Methods
We accept payment via PayPal, Payoneer, bank transfer, and other methods agreed upon in writing. All fees are quoted in US dollars unless otherwise stated.
4.3 Late Payment
Invoices are due on the date stated. If payment is not received within 14 days of the due date, we reserve the right to pause work on the project until the account is brought current. Continued non-payment may result in project cancellation. Delivered files remain the property of Pugo Design Studio until all outstanding balances are settled in full.
4.4 Refunds
Deposits are non-refundable. If a client cancels a project after work has begun, payment is due for all work completed up to the date of cancellation. Refunds for completed and delivered work are not provided.
5. Intellectual Property and Ownership
5.1 Transfer of Ownership
Full ownership of final design files is transferred to the client upon receipt of complete payment. Until payment is received in full, all work produced by Pugo Design Studio remains the intellectual property of Pugo Design Studio.
5.2 Working Files
Source files, working files, layered files, and native application files are not included in the standard project delivery unless explicitly agreed upon in the project proposal. Provision of source files may be subject to an additional fee.
5.3 Portfolio Use
Pugo Design Studio reserves the right to feature completed work in its portfolio, on its website, and across its social media channels unless the client requests in writing that the work remain confidential. This right applies to all work upon final delivery.
5.4 Third-Party Assets
If a project requires the use of stock photography, licensed fonts, icons, or other third-party assets, those assets remain subject to their respective license agreements. It is the client’s responsibility to ensure continued compliance with those licenses after project delivery.
6. Client Responsibilities
To enable us to deliver work on time and to standard, clients agree to:
- Provide accurate, complete, and timely information, content, and feedback when requested.
- Respond to questions and review requests within the timeframe agreed in the project timeline.
- Ensure that all content, images, text, logos, and other materials supplied to Pugo Design Studio are owned by the client or that the client has the right to use them.
- Obtain any necessary approvals or sign-offs required on their end before submitting feedback.
Delays caused by late responses, missing content, or slow approvals from the client side may affect the agreed project timeline. Pugo Design Studio is not responsible for missed deadlines resulting from delays caused by the client.
7. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of a project that is not publicly available. This includes but is not limited to business strategy, unreleased products, pricing, and client data.
This obligation of confidentiality continues after the project is completed or the engagement is ended.
8. Website Use
8.1 Permitted Use
You may use pugodesigns.com for lawful purposes only. You agree not to use the site in any way that could damage, disable, or impair the site or interfere with any other party’s use of the site.
8.2 Accuracy of Information
We make reasonable efforts to keep the information on our website accurate and up to date. However, we do not warrant that all content is complete, current, or error-free. Pricing, services, and availability are subject to change without notice.
8.3 External Links
Our website may contain links to third-party websites. These links are provided for convenience only. Pugo Design Studio does not endorse, control, or accept responsibility for the content of any linked third-party site.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Pugo Design Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to loss of revenue, loss of data, or business interruption.
Our total liability to any client in connection with any project shall not exceed the total amount paid by that client to Pugo Design Studio for the specific project giving rise to the claim.
10. Warranties and Disclaimers
Pugo Design Studio warrants that all work delivered is original and does not knowingly infringe on the intellectual property rights of any third party. We do not warrant that our services will meet every specific outcome or business result the client expects.
The website and all content on it are provided on an “as is” basis without warranties of any kind, either express or implied.
11. Termination
Either party may terminate a project or retainer engagement by providing written notice. In the event of termination:
- All work completed up to the termination date is billable
- Delivered files remain the property of Pugo Design Studio until all outstanding balances are paid
- Deposits are non-refundable
Pugo Design Studio reserves the right to terminate any engagement immediately and without notice if the client engages in conduct that is abusive, unlawful, or in breach of these terms.
12. Governing Law
These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms or from any project engagement that cannot be resolved between the parties directly shall be subject to the jurisdiction of the appropriate courts in Cebu City, Philippines.
Clients outside the Philippines acknowledge that they are engaging a Philippines-based studio and agree that Philippine law governs the engagement.
13. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
